Why Not Equal Time?

  • Jordi Bennedict

I came across a discussion about a parent who wanted equal parenting time and started wondering about the legal standard behind these cases. If neither parent is abusive, neglectful, or otherwise unsafe, what is the strongest argument against starting with 50/50 custody? Shouldn't any different arrangement require a specific reason rather than being the default?

    • A custody discussion in my wider family got me thinking about this too. Both parents were involved, neither presented obvious safety concerns, but the process still became a debate over who should get more time. I found the Law Times article on Bill C-560 interesting because it explains the arguments around equal shared parenting: parental rights and custody . It’s a useful read if you’re weighing the case for 50/50 against exceptions based on the child’s circumstances.

    • Honestly, this is one of those topics that looks simple until you see how many details can change the picture. I appreciate the Bill C-560 article because it lays out the arguments without making it sound like 50/50 automatically works for every family. The child’s routine, school, distance between homes, and how well the parents actually cooperate seem just as important as the principle of equal time. Thanks for sharing the link — definitely gave me a few things to think about.
